Practice Areas
David A. Fitzsimons is in his 25th year of practice across central Pennsylvania.
He focuses his practice in the area of dispute resolution, representing individuals
and companies in contract and business dispute resolution, with emphasis
on construction, employment, land use and estate-related litigation. Over
the past ten years, David has applied his expertise as a neutral mediator
to the successful resolution of numerous disputes in the areas of Commercial
Contract, Construction, Employment Law, Business Sucession and when court-appointed,
Personal Injury.
Professional Activities
Mr. Fitzsimons is Chair of the Cumberland County Bar Association
ADR Committee, focusing on Mediation and Arbitration, and Chair
of the CCBA's Fee Dispute Committee. He is a
member of the Pennsylvania Bar Association Committee on Legal
Ethics and Professional Responsibility, and a Master Emeritus
with the James S. Bowman American Inn of Court in Harrisburg
Pennsylvania.
He is a Member of the Cumberland County, Dauphin County and Pennsylvania
Bar Associations, in addition to the American Bar Association.
He is also a member of the certified Mediator Panels for the
United States Courts of the Middle District of Pennsylvania, the
Cumberland County Panel of Mediators and Arbitrators, and
Dauphin County Mediators Panel.
In addition to admission to all courts of Pennsylvania, he is admitted to the
United States District Courts for the Middle and Eastern Districts of Pennsylvania,
the Eastern District of Wisconsin, the U.S. Third Circuit Court of Appeals and
the U.S. Supreme Court. Since 1994, he has served as an advocacy adjunct instructor
at Dickinson School of Law.
Education
Mr. Fitzsimons graduated from Washington College with a B.S. in International
Studies in 1980 and earned his law degree at The Dickinson School of Law
in 1984.
Publications and Presentations
Mr. Fitzsimons is the author of the Pennsylvania Construction Code Act,
an article presented at the Municipal Law Colloquium of the Pennsylvania
Bar Institute in May of 2003. He has lectured on a number of occasions for
the Pennsylvania Bar Institute on the topics of construction, municipal and
legal ethics issues.
